These Terms & Conditions ("Terms") govern your use of the JM Training Performance mobile application (the "App"), operated by JM Training ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to create an account and use the App. By using the App, you represent that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal mobile device for your own personal, non-commercial use. You may not copy, modify, distribute, lease, reverse-engineer, or create derivative works from the App or any part of it, except as permitted by applicable law.
You agree not to use the App to:
The App includes community features where members can post, comment, and interact. Treat other members with respect. We reserve the right, but have no obligation, to monitor, moderate, or remove any content, and to suspend or remove any member who violates these Terms or our community standards. Content posted by other users reflects the views of those users, not of JM Training.
You retain ownership of the content you post in the App ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide license to host, store, display, and distribute that content within the App for the purpose of operating and improving the App's features. You represent that you have all rights necessary to post your User Content and that it does not infringe the rights of any third party.
The App provides educational content related to personal safety, firearms training, and skill development. This content is provided for general educational purposes only. It is not legal advice, and it is not a substitute for in-person, qualified instruction. Firearms laws vary by jurisdiction, and you are solely responsible for knowing and complying with the laws that apply to you. Always follow the fundamental rules of firearm safety. Any physical training or practice you undertake based on content in the App is done at your own risk.
The App and all of its content - including courses, videos, text, graphics, logos, trademarks, and software, but excluding User Content - are the property of JM Training or its licensors and are protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms grants you any right to use the JM Training name, logos, or trademarks without our prior written consent.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
The App may rely on or link to services operated by third parties, including app distribution platforms and hosting providers. We are not responsible for the content, policies, or practices of any third-party service. Your use of the Apple App Store or Google Play is also subject to those platforms' own terms.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, JM TRAINING AND ITS OWNERS, EMPLOYEES, INSTRUCTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless JM Training from any claims, damages, liabilities, and expenses arising out of your use of the App, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App and request deletion of your account at any time through the App's settings or by contacting us. Sections of these Terms that by their nature should survive termination will survive.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. The "Last updated" date above reflects the most recent revision. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts.
